1. 개요

정당법
제2조(정의) 이 법에서 “정당”이라 함은 국민의 이익을 위하여 책임있는 정치적 주장이나 정책을 추진하고 공직선거의 후보자를 추천 또는 지지함으로써 국민의 정치적 의사형성에 참여함을 목적으로 하는 국민의 자발적 조직을 말한다.

정당이란, 정치적 뜻을 같이 하는 결사체로 정권의 획득을 목표로 한다. 각 개인이 단독으로 정치적 의견을 표출하는 것의 한계점을 극복하고자 생겨난 제도이다. 정당의 체계는 보통 19세기 말에 완성되었으며 현대적인 정당의 개념은 조반니 사르토리에 의해 정립되었다.

구체적인 정당의 형태는 나라별로 정치제도(의원내각제, 대통령제, 이원집정부제 등)에 다르며[2] 경제 발달 수준에도 영향을 받는다.

2. 특징

2.1. 정강

정강 또는 강령이란 정당이 국민들에게 제시하는 정당의 이념과 정책적 노선을 반영한 공약으로서 집권을 통해서 달성하고자 하는 정책의 큰 줄기를 말한다. 흔히 정강 · 정책이라고도 많이 말하는데, 구체적으로 정당의 정치적 방침을 정강이라고 하고 정강을 달성할 정치적 수단을 정책이라고 한다.

이념정당, 계급 정당의 경우에는[3] 명확하고 뚜렷하게 제시하고 포괄정당, 국민정당(Catch-all party)의 경우에는[4] 상대적으로 모호하고 여러 가지 정책적 노선을 최대한 많이 포섭하는 방향으로 제시하고 있다. 그래서 빅텐트 정당, 국민정당의 경우에는 정강·정책뿐만 아니라 정당 내부의 계파들의 정치적 성향도 하부 분파로서 같이 제시하는 편이다.

일반적인 정강·정책과 다르게 선거철마다 발표하는 정강·정책이 있는데 그것이 선거를 통해서 집권할 경우 지속적으로 추진하려고 하는 목표다. 보통 주어진 임기 내에 달성할 수 있는 것을 제시하는 경우가 매우 많다. 선거철마다 일반 유권자들이 받은 선거공보물의 공약이 여기에 해당된다.

한국 정치에서 정강·정책은 진보정당이 먼저 구체적으로 제시하기 시작했고 다음으로 새정치국민회의 이후로 민주당계 정당이 구체적으로 제시하였고 새누리당 이후로 보수정당도 구체적으로 제시하고 있는 추세다. 과거의 정당들이 모호하고 보기 좋은 말들로 수사하는 식에 가까웠다면 정치의 경쟁이 심화되면서 구체적인 이념과 구체적인 정책을 정강·정책을 통해서 제시해서 정당이 추구하는 가치에 동의하는 국민들을 끌어모으기 위해서 노력하고 있다.

2.2. 다른 단체들과 비교

정당은 궁극적으로는 국가의 정권을 획득하는 것을 목표로 하기 때문에 다른 이익단체, 정치단체, NGO들과는 구별된다. 대한민국은 중앙선거관리위원회에 등록하지 않은 단체[5]가 "(정)당"이라는 명칭을 사용할 경우 형사처벌하는 조항을 둘 정도로 정당과 정당 아닌 정치단체를 명확히 구분하는 편이다.

한편 정당 외에도 정치 권력을 얻기 위한 계파나 파벌들은 현대적 정당의 탄생 이전에도 물론 존재했다. 로마 공화국 말기의 옵티마테스/포풀라레스가 대표적이고, 한국사 수업 시간에 한 번쯤은 들어봤을 붕당도 마찬가지다. 정치학자 조반니 사르토리 [6]가 "모든 정당은 파벌이지만 모든 파벌이 정당은 아니다"라고 말한 바 있다. 절대적인 것은 아니나 대략적으로 정당과 정치 파벌의 차이를 짚어보자면 아래와 같다.

소속원의 규정
첫째로 정치 파벌은 그 파벌에 속한 소속원을 규정하는 공식적인 규정이 없다. 즉 어떤 정치인이 어느 파벌에 소속돼있는지 분명하지 않을 수도 있다는 것이다. 예를 들어 진박이니 범친노니 하는 용어들을 보면 알 수 있다.[7] 반면 정당은 공식적인 '당적'이라는 것이 있기 때문에 입당, 탈당 과정에 의해 정당의 소속원이 분명하게 규정되고 강령과 당규에 따라 당이 운영된다.

자유로운 입출당 및 정치적 영향력 행사
두번째로 근대 이전 대부분 국가의 정치는 지배계급의 전유물이었기 때문에 근대 이전의 정치 파벌이나 정치적 비밀결사들 또한 대부분 귀족, 엘리트들이나 정치인들만의 조직이었다. 즉, 정치인과 관계없는 일반 백성이 그러한 정치 파벌의 소속원이 되거나 참여하는 것은 거의 불가능했다. 반면 근대적 정당은 정치인들뿐만 아니라 정치인이 아닌 일반인들도 당비를 내고 입당하여 당원이 되는 것이 가능하다.
아울러 당원이 되지 않더라도 투표를 통해 일반 대중들이 공식적으로 어떤 정당을 지지하여 정당에 큰 영향력을 끼칠 수 있다. 앤드류 잭슨의 민주당을 근대 정당 정치의 효시로 보는 것도 이 때문이다. 이전까지 정치인들 사이의 파벌의 지지가 선거의 당락에 영향을 끼치는 것에 반대하여 앤드류 잭슨은 정치인뿐만 아니라 일반 대중의 지지를 받아 존속하는 정치세력을 만들고자 했기 때문이다.

명확한 규율
정치 파벌은 명확한 규율이 없어서 체계적인 통제가 불가능하여 그 세력이 커질 경우 문제가 생길 수 있기 때문에, 현대에는 당의 강령과 규칙 등을 우선시하여 이러한 문제점들을 규칙을 통하여 관리할 수 있는 정당의 형태로 등록하게 하는 것이 일반적이다.

민주주의가 아닌 독재국가나 일당제 국가의 정당이라도 강령과 당규가 존재하며 정치인이 아닌 사람이 당원이 되는 것은 가능하므로 형식적으로는 정당이 되는 요건을 갖추었다고 본다.

2.3. 규모

정당의 규모는 천차만별이다. 정식등록된 엄연한 정당이지만 웬만한 동호회 보다 작은 정당도 많으며[8], 반대로 몇몇 정당은 군대를 소유하고 국가 전반의 행정을 담당하는 등 국가권력 전체를 장악하기도 한다.[9], 그 중에서는 세계 초강대국 급의 권력을 가진 정당도 존재한다.[10]

3. 정당제

정당이 운영되는 정치 체제를 정당제라고 한다.[11] 다당제를 기반으로 하고 있는 편이다.

일당제: 하나의 당만이 인정되고 정부를 운영하며 다른 당은 선거에 참여할 수 없는 정당제. 자세한 것은 일당제 문서 참조.
일당우위제: 다른 정당보다 압도적인 하나의 정당이 중심이 되는 체제 혹은 현상. 1개 정당의 우위가 제도적으로 뒷받침된 것은 패권 정당제로 구별하곤 한다.
양당제: 복수정당체제 중에서도 다른 정당보다 압도적인 두 당이 중심이 되어 경쟁하는 체제 혹은 현상. 자세한 것은 양당제 문서 참조.
다당제: 3개 이상의 정당이 서로 경쟁하는 체제. 대표적으로 독일, 프랑스, 이스라엘과 브라질의 예가 있다. 구심적 경쟁을 하는 분절적 다당제, 원심적 경쟁을 해서 양극화가 나타나는 분극적 다당제로 세분할 수 있다.

이 중 일당우위제, 양당제는 대체로 제도적으로 규정된 것은 아니고 그러한 정치 구도를 가리키는 표현이다.

3.1. 복수정당제의 형태

복수정당제를 채택하고 있는 나라라도 그 세부적인 형태는 정당의 관계에 따라 조금씩 다를 수 있다. 크게 합의형성형(consensual), 대립형(conflictual), 다원통합형(혹은 다극공존형, consociational)으로 나뉜다.

합의형성형: 국가의 기본적인 이념에 대해서는 논의를 거친 후 합의를 보이고, 구체적인 방법론에 대해서만 의견 차이를 보이는 형태.
대립형: 국가 성립에 관한 가장 기본적인 이념에 대해 다른 의견을 허용하는 형태. 한 국가 안에 공산주의 정당과 자본주의 정당이 공존하는 프랑스, 네팔 같은 국가들이 여기에 해당한다. 관내 대부분의 정당이 건제파, 민주파, 본토파 3개 중 하나로 분류되는 있는 홍콩도 여기에 해당한다. 전국정당 없이, 모든 정당이 지역정당으로서 국가의 해체까지도 주장하는 정당들로 구성된 벨기에도 비슷한 부류다.
다원통합형: 매우 다양한 입장이 공존하며 그들이 연합하여 정치세력을 형성하는 형태. 다문화국가이거나 지역색이 매우 강하고, 그러면서도 그들의 의견을 수렴하는 것이 물리적으로 가능한 소국에서 나타나는 형태이다. 스위스, 오스트리아, 베네룩스 3국 등이 해당한다.

3.2. 정당 구분론

조반니 사르토리는 정당 구분론을 주장했는데 다음과 같다.

정당은 파벌이 아니다.
정당은 전체 속의 구분이다.
정당은 의사 표현의 통로이다.

라고 주장하며 다음과 같은 정당 구분론을 제시했다.

경쟁적 체계(정당체계, 다원주의, 자유(표현))
비경쟁적 체계(정당국가체계, 단일중심주의, 독재(억압))

이 두 체계의 사이에는 경계점이 존재하며, 이 두 체계는 양립할 수 없으며, 어떤 한 체계가 바뀌려면, 혁명 또는 쿠데타가 일어나서 어느 한 체계가 붕괴하지 않는 한 체계 전환이 불가능하다고 보았다.

이 것은 오늘날 현대 정당 체계 분류의 시초이다. 각 나라의 이데올로기나 체계에 따라서 세부적으로 분류해야 한다고 주장하기도 했다. 이를테면, 사회자유주의, 자유주의, 민주사회주의, 공산주의 같은 사상이나, 극좌, 좌파, 중도좌파, 중도주의, 우파, 극우 같은 정치성향이 이러한 이데올로기에 속한다.

여하튼 대표적으로 비경쟁적 정당 체계인 일당제와 헤게모니 정당제, 경쟁적 정당 체계인 일당우위제, 양당제, 온건 양당제, 분극적 다당제, 원자화 정당제 7가지로 나눌 수 있다고 주장한다.

비경쟁적 체계

일당제는 단 하나의 정당만 존재하며, 야당이 명목상으로도 존재하지 않는 것을 말한다. 억압적이고 침투적에 비관용적이고 추출적인 성향이 강하다. 소련 같은 전체주의 일당제, 프랑코 치하의 스페인 같은 권위주의 일당제, 실용주의 일당제로 유형화할 수도 있다고 말했다.
헤게모니 정당제는 패권정당제라고도 하는데, 패권정당 이외의 정당은 존재 자체는 허용되지만, 권력을 둘러싼 경쟁은 허용하지 않는 체계이다. 위성정당과 패권정당의 2층 체제로 존재하며, 추출성과 억압의 정도에 따라서 구분이 가능하다. 이들의 성향은 폴란드 인민공화국처럼 이데올로기 지향으로 나타나기도, 제도혁명당 집권기 멕시코처럼 실용주의 지향으로 나타나기도 한다.

경쟁적 체계

일당우위제는 둘 이상의 정당이 절대 다수 의석을 위해 경쟁하지만, 항상 어느 한 정당이 다수 의석을 차지하는 바람에 정권교체가 장기적으로 없는 체계를 얘기한다. 일본이 대표적이다.
양당제는 두 정당이 절대 다수 의석을 위해 경쟁하며, 어느 한 정당이 과반수 획득에 성공하여 단독 정권을 형성하고 양당 간의 정권 교체나 일어나거나 일어날 것이라는 기대를 가질 수 있는 체계이다. 현재의 미국, 대한민국이 이러한 성향을 가지고 있다.
온건다당제는 이데올로기적으로 양극화 되어있지 않은 3개에서 많게는 5~6개의 정당을 갖는 체계이다. 양당제와 달리 연립정권지향형이다. 쉽게 말하면 연정이 가능하다는 얘기이며, 다차원성과 분절화가 두드러지게 나타나는 특징이 있다. 독일이나 벨기에, 스웨덴이 대표적.
분극다당제는 분열이 심화되어 있고, 이데올로기적으로 양극화 되어 있는 5~6개의 정당으로 구성된 체계를 말한다. 어느 한 정당도 집권에 필요한 득표를 못 해서 정당들이 서로 연립해야 하는 상황에 있으며, 이념적 갈등으로 불안정한 정부 구성, 반체제정당과 상호배타적인 쌍두 야당이 존재하며, 이데올로기의 유형적 패턴화, 무능한 야당, 공약남발의 정치 등이 특징이다. 바이마르 공화국 시절의 독일, 제2차 세계 대전 직후의 이탈리아가 그 예.
원자화된 정당제는 경제에 있어 원자적 경쟁처럼 어떤 정당도 지배적이지 않고, 다른 정당에도 아무런 영향을 끼치지 못 하는 상황에서 나타나는 체계이다. 당명이 수시로 바뀌는 것도 모자라 정치세력들의 이합집산이 빈번한 국가가 대표적이다. 네덜란드나 이스라엘 같이 완전비례대표제 국가에서 흔히 보이며, 연립정부 내각의 구성이 일상화된 국가에서는 오히려 분극다당제보다 훨씬 나은 정치 환경을 보여준다. 다만 페루 같이 끔찍한 정치 환경의 결과물일 수도 있다.

4. 설립과 가입

4.1. 설립 기준

대한민국은 5개 이상의 광역자치단체에서 각각 1000명 이상의 당원을 필요로 한다.(정당법 제4조, 제17조, 제18조) 즉 최소 5,000명 이상의 당원이 필요한 것인데, 대한민국 인구가 5,000만 명이니 0.01%에 해당한다. 게다가 대한민국 인구 5,000만 명은 단순히 인구 수 기준으로 한 것이며, 당원 자격을 갖추려면 투표 자격이 있어야 한다. 21대 총선 기준으로 유권자가 4,300만 명이였던 걸 생각해보면, 그 기준은 훨씬 더 높아진다.

영국(인구 6,500만)에서는 전국단위 정당을 만들려면 당원 1,000명 이상이 있어야 하고, 지역단위 정당을 만들려면 당원 수 200명 이상이면 가능하다.

미국(인구 3억 3천만)은 워싱턴 D.C.에 중앙당 등록을 하고 최소 1개 주에서 500명 이상의 당원을 모으면 정당 설립이 보장된다.

일본(인구 1억 2,300만)은 전국에서 1000명 이상의 당원을 확보하면 정당을 만들 수 있으나, 일본의 정당법에 따라 이들은 정식 정당이 아닌 정치단체로 분류된다. 정당으로 인정받으려면 전국단위에서는 국회의원 5석(중의원, 참의원 합산)이나 가까운 전국단위 선거[12]에서 전국 정당득표율 2% 이상을 기록했어야 한다. 정당에 비해서 정치단체의 경우 활동에 몇몇 제한이 존재한다.[13] 일본에서는 지정된 1개 도도부현에서만 활동하는 지역정당도 가능한데 지역정당은 당원 수를 300명 이상만 확보하면 된다.[14] 또한 일본은 등기소에 등기하도록 되어 있고, 정당교부금을 받는 정당 등에 대한 법인격 부여에 관한 법률도 존재한다.

대만(인구 2,300만)은 전국 단위 기준으로 최소 당원 수 500명이다.

홍콩(인구 740만)은 최소 당원 수 2명이라는 파격적인 조건이다. 홍콩은 아예 물리적 정당 사무실도 필요가 없다. 타이완과 홍콩은 정당 설립이 자유이지만 정치적 성향에 따라 범람연맹/범록연맹(타이완), 건제파/민주파/본토파(홍콩)를 선택하여 연대하는 것이 일상적이다. 인구 740만 홍콩에 있는, 활동중인 정당 수가 250개에 달한다.

베네수엘라(인구 2,900만)는 최소 당원수 50명이다.

인도(인구 13억 8천만 명)는 정당 설립에 필요한 최소 당원 수가 100명이다. 대신에 국고보조금을 지원받으려면 인도 국회나 인도 지방의회에 당선자가 있어야 한다. 인도는 등록되어서 활동하는 정당 수가 2,700개에 달한다.

4.2. 가입 방법

정당의 당원이 된다는 것을 막연히 어렵게 생각하는 경우가 많지만 해당 국가에 소속된 국민이라면 별도의 금지 조항이 없는 경우 누구든지 해당 국가의 정당에 자유롭게 가입할 수 있다. 21세기에는 온라인 입당을 통해서 인터넷으로 간편하게 입당할 수 있다. 단, 입당 신청을 한다고 해서 곧바로 당원이 되는 것은 아니고 정당 측에서 심사를 하기 때문에 최소 1일~최대 14일 정도 걸린다.

이렇게 심사를 무사히 마치고 본격적으로 당원이 되면 1달에 최소 1000원 이상 납부해야 한다.[15] 다만 이는 권리당원 한정으로 일반당원의 경우 월간 정당비를 납부하지 않아도 된다.[16]

대한민국에서는 1950년대 명망가 정당의 수준에서 1960년대 최초의 근대정당으로서 간부정당이었던 민주공화당을 시작으로 민주화 이후에는 주요정당들이 모두 대중정당으로 완전히 변모하였다.
