聽聞會 ｜ hearing, Inquiry위원회가 중요한 안건을 심사하거나 국정감사 또는 국정조사를 실시함에 있어, 판단의 기초가 되는 정보나 자료를 수집하기 위하여 증인 등을 출석시켜 증인을 청취하는 것.
2. 의의와 성격
한국에서 청문회는 대체로 이미 증인들의 잘못이나 책임의 증거를 확보한 후 이를 공개적으로 추궁하려는 목적으로 개최된다. 청문회는 추궁하는 쪽에만 대본이 있는 일종의 연극이다. 단순한 비유가 아니라 실제로 그렇다. 청문회에서 조사관들이 써준 대본을 읽기만 한 위원들도 있었다. 물론 내용에 대한 이해가 없으면 이 연극은 실패한다. 특조위만의 문제라기보다 한국 청문회의 관행이다. 국회 보좌관들은 국회의원들을 위해 언제 삿대질을 해야 하는지까지도 지시문으로 넣는다.

청문회는 내용에 따라 입법청문회, 조사청문회, 인사청문회로 나뉜다. 입법청문회는 입법 현안에 대한 정보나 전문적 지식을 듣는 데 목적이 있고, 조사청문회는 특정 쟁점에 대한 사실관계나 진상을 규명하는 데 초점이 맞춰진다. 인사청문회는 고위 공직자 후보자의 자격과 적합성을 검증하는 자리다.
이 중 입법청문회는 사실상 국회 차원의 자문 절차에 가까워 분위기도 상당히 점잖고 정제되어 있는 편이다. 반면 일반적으로 사람들이 '청문회'라고 할 때 떠올리는 건 대부분 조사청문회나 인사청문회다. 둘 다 책임 소재가 있는 사람을 국회로 불러놓고, 높으신 분들이 단체로 날카로운 질문을 던지는 자리이다 보니, 聽(들을 청), 聞(들을 문)이라는 한자 의미와는 달리 오히려 오금이 저릴 정도로 압박감 넘치는 자리로 여겨진다. 갈굼을 공식적이고 점잖게 하는 자리라고 봐도 무방한 격.
특히 2000년부터 시작된 고위 공직자 인사청문회는 그 강도가 더 세진 편인데, 임명을 못마땅하게 여기는 쪽에서 거의 악마의 변호인 수준으로 집요하게 파고드는 경우도 있다. 이 과정에서 국민들조차 전혀 몰랐던 비리 사실이 지상파 방송으로 생중계되는 사례도 꽤 많다.
聽(들을 청), 聞(들을 문)이라는 이름 그대로 청문회는 원칙적으로 모든 국민이 그 과정을 들을 수 있도록 공개를 기본으로 한다. 다만 후술하겠지만, 예외적으로 비공개로 진행되는 청문회도 존재하긴 한다.
행정절차에서도 청문이라는 것이 있는데, 명칭은 청문회와 비슷하지만 개념이 다르다.
3. 청문회 제도의 실제
3.1. 청문회의 개최
3.1.1. 개최요건
제15대국회 국회법개정 전에는 위원회의 의결로만 청문회를 개최할 수 있었으나, 제15대국회 국회법개정(2000.2.16)에서 위원회의 의결로 개최할 수 있음은 물론, 법률안의 심사를 위한 청문회의 경우에는 재적위원 3분의 1 이상의 요구로 개회할 수 있도록 요건을 완화하였다.국회법 제65조2항 또한 제정법률안이나 전부개정법률안을 위원회에서 심사하는 경우 위원회의 의결로 생략하지 아니하는 한 공청회 또는 청문회를 개최하여야 한다.국회법 제58조6항3.1.2. 대상안건
위원회에서 심사하는 모든 안건에 관한 것이 아니라 중요한 안건의 심사나 국정감사 또는 조사와 관련하여 증언, 진술의 청취, 증거의 채택 또는 증거의 조사를 위하여 필요한 경우 청문회를 개최할 수 있다. 중요한 안건인지 여부는 위원회가 결정하며 안건은 안을 갖추어 소정의 절차를 거쳐 제출한 의안[2] 청원 기타의 사안[3]을 의미한다.3.1.3. 사전조사
청문회 사전조사제도는 청문회에 필요한 자료를 사전에 충분히 확보하여 청문회의 실효성을 제고하기 위한 것이다. 제15대국회 국회법개정(2000.2.16)에서 청문회를 위한 사전조사제도를 도입하여 청문회 개최시 필요한 경우에는 외부전문가를 위촉하여 사전조사를 실시할 수 있도록 근거규정을 마련하였다. 제18대국회 국회법개정(2011.5.19)에서 청문회의 사전준비를 내실화하고자 사전조사요원의 범위를 확대하여 국회사무처, 국회예산정책처, 또는 국회입법조사처 소속 공무원이나 교섭단체의 정책연구위원도 위촉이 가능하도록 하였다. 전문가의 위촉에 관한 절차 등은 국회법 제43조(전문가의 활용)를 준용한다.3.1.4. 개최보고 및 공고
위원회가 청문회를 개최할 때에는 안건, 일시, 장소, 증인, 경비 기타 국회의 대표인 국회의장이 참고하여야 할 사항을 기재한 문서로 국회의장에게 보고하여야 하고, 개회 5일전에 안건, 일시, 장소, 증인 등 필요한 사항을 위원장이 공고한다. 통상 청문회 공고는 국회홈페이지에 게시하고 국회공보 등에 게재하고 있다.3.2. 청문회의 운영
3.2.1. 정족수
청문회는 주관하는 위원회의 회의이므로 재적위원 5분의 1 이상의 출석으로 개회한다. 또한 국정감사 또는 조사를 위하여 구성된 소위원회 또는 반에서 청문회를 개최하는 경우에도 이를 준용한다.3.2.2. 공개

청문회는 주관하는 위원회의 회의이므로 해당 위원회는 안건과 관련된 보고나 필요한 서류의 제출을 요구하고 증인 등을 출석시켜 증언을 청취하며, 필요한 경우 검증을 행할 수 있다. 이러한 서류제출, 증언 등에 대하여 국회법에서 정하고 있는 것을 제외하고는 국회에서의 증언·감정 등에 관한 법률에 따르도록 하고 있으므로 이러한 절차는 국정감사 또는 조사상의 서류제출이나 증인 등의 출석요구 등과 동일하다.국회법 제127조~129조3.2.4. 증인선정 및 신문
증인 등의 선정과 증언시간은 공청회의 규정을 준용하므로 위원회가 이를 정하여야 할 것이나, 신문(訊問)방법과 신문시간, 신문순서 등에 대하여는 명문의 규정이 없으므로, 위원장이 간사와 협의하여 정하거나 위원회에서 의결로 정하여야 할 것이다. 다만, 신문방법에 있어서 신문의 성격상 단독신문이 원칙이나 필요한 경우 대질신문 등의 방법이 이용될 수 있으며, 위원장은 간사와 협의하여 중복신문을 피하고 효율적인 신문이 되도록 신문시간을 어느 정도 제한할 수 있다.3.3. 청문회의 기록과 결과 보고
3.3.1. 청문회의 기록
청문회는 위원회의 회의이기 때문에 그 회의록은 위원회회의록의 작성에 관한 국회법의 규정에 따라 작성·배부하며국회법 제69조, 제118조, 청문회에 출석한 증인이 신문요지에 대한 답변서를 제출국회증언감정법 제5조5항한때에는 해당 증인이 출석·증언한 날의 청문회 회의록에 게재한다. 또한 증인 등이 자기가 증언 또는 진술한 부분에 대하여 자구 등의 정정을 원하거나 시간관계로 다하지 못한 증언 또는 추가로 증언할 내용이 있어 이를 서면으로 제출한 경우, 명문의 규정은 없으나 의원의 경우에 준하여 증언의 취지를 변경하지 아니하는 범위 안에서 위원장의 허가를 받아 자구등의 정정을 인정하거나 회의록에 게재할 수 있을 것이다.국회법 제116조, 제117조3.3.2. 청문회의 결과보고
청문회를 종료한 경우 청문회의 결과 보고에 대한 명문의 규정은 없으나 청문회가 일반적으로 위원회안건심사, 국정감사 및 조사와 관련하여 정보 또는 자료를 수집하기 위한 것이므로, 결과 보고는 관련 안건에 대한 최종결과를 본회의에 보고할 때 포함시키는 것이 바람직하다.3.4. 국회법에서의 청문회 조항

5. 해외 정치사의 청문회

다만 한국과는 달리 국정감사가 없다. 미국은 영국의 식민지 13주였던 시절에는 영국의 제도를 따라 조사만 하고, 처벌을 할 수 없었는데[4] 미국 독립전쟁 과정에서 자잘한 비리가 많이 적발되고 이에 대한 책임문제[5] 규명을 위해 국정감사의 필요성을 느끼게 된다. 하지만 막 독립해 국가로 틀을 갖춘 미국은 국정감사와도 같은 강력하고도 부정기적인 정치행세를 할 여유가 없었기에 헌법에서 국정감사에 대한 개념을 빼버리는 대신 상시청문회 제도를 정착시켜 사실상 상시 국정감사를 진행할 수 있는 토대를 만들었다. 여러 정황상 영국식 국정조사의 안티테제이자 미국형 국정감사로 추진된 상시청문회제도는 초기에 정치적인 매장수단으로 악용되었지만, 꾸준히 제도의 투명화와 개선이 이루어져 근대에 이르러선 미국 의회의 일상적인 업무로 인정받게 되었고 특정사안에 대한 국정감사를 시작할 경우 수사본부를 의원들이 직접 설치하고 공표하는 등의 보완이 이루어지고 1921년 감사원(GAO)이 만들어지게 되며 상설청문회 시대를 열게 된다. 근대적 정당 정치를 오랜 시간 동안 유지하고 계승한 국가다보니 청문회도 상당히 빡세다. 후보자의 아주 사소한 도덕적 결점이나 실수도 무자비하게 캐고 물어뜯는다. 하여튼 미국 청문회는 정말 살벌하기 그지없어서 한국의 국정감사는 애들 장난처럼 보일 정도다. 한번 꼬투리 잡히면 몇 번이고 몇 명이고 목이 훅 날라간다.
마크 저커버그가 상원청문회에 불려갔을 때의 모습이 외계인이나 랩틸리언 같다는 밈이 돌았는데, 이런 식으로 기자들이 몰려있어서 긴장할 수밖에 없었다. 다만, 위 사진은 포토샵으로 과장되게 조작이 들어간 사진이니 참고할 것.
청문회 내용과는 연관이 전혀 없는 주제를 가져와서 난장판을 만드는 상황이 있는데 이에 대해 사우스 파크를 통해 유명해진 미국 법조계의 은어인 츄바카 변호가 있다. 2026년 2월 12일, 제프리 엡스타인 성범죄 사건과 관련해 팸 본디에 대한 청문회가 진행되었는데 이 정의에 부합하는지라 실제로 츄바카 변호를 시전했다며 놀림감이 되었다.
대만은 인사청문회만 존재한다. 국민 찬반이 치열한 법안에 대해서는 청문회나 공청회 대신 바로 국민투표로 넘어가는 게 보통이다.
중국은 청문회 없어도 법안이 입법되는 사례가 매우 흔하다. 전국인민대표대회 자체가 중국 최고지도자 시진핑의 거수기일 뿐이다. 전인대 국회의원이 무려 3,000명이나 되는데 이들이 죄다 거수기인 셈. 이는 중국이 청문회를 생략하면서 모든 국민들은 과정을 잘 알지 못하도록 우민화 정책을 펼치기 때문이다. 중국은 인구가 13억이나 되기 때문에 고작(?) 3억밖에 안 되는 미국처럼 일일이 청문회를 하면서 정책을 펼치다보면 시간이 굉장히 오래 걸릴 뿐더러 되레 비효율적이라 하지만, 미국의 3억 인구도 결코 적은 숫자가 아니라는 것을 보면 이는 그저 핑계다. 하다못해 연방제만 해도 중앙의 부담은 줄어들고 반응성은 늘어난다. 미국, 러시아, 인도, 브라질 등등이 연방제인 이유가 여기 있다. 중국이 주석에게 모든 권한을 몰빵하는 것은 "국가의 운영에 효율적"이기 때문이 아니라, 그게 "독재에 효율적"이기 때문이다. 즉 중국 공산당이 민주주의와 연방제 등으로 권력을 나누긴 싫어하는 탓이다.
영국과 프랑스는 전반적으로 미국과 분위기가 매우 비슷하다. 영국의 법안 청문회는 그리 치열하다고는 못한다. 사실 영국은 한국에는 생소한 본회의 중심주의를 채택하고 있기 때문에 본회의 자체가 독회다 뭐다 해서 치열한 편.[6] 영국의 법안 공청회나 청문회는 특징이 서면 청문회가 있다는 것. 즉 말로 기세를 타는 게 아니라 침묵 속에 상대방이 제시한 글을 보고 그 자리에서 반박 글을 써서 내는 서면 청문회가 있다. 물론 육성 청문회도 있는데 육성 청문회는 미국처럼 치열하게 전개된다.
독일은 청문회를 강의처럼 참관이 가능하다.
이탈리아는 의회에서 상호 질의 응답 시간을 자주 가지며, 특별한 경우가 아닌 일상적으로 열린다. 그리고 국회의원 1명만 요청해도 청문회가 열린다. 청문회 불참시 정확한 사유서를 제출해야 하지만, 반강제적으로 대부분은 참석한다.
일본은 전반적으로 한국과 비슷하게 돌아가지만 중의원 예산위원회에서 청문회를 실시한다. 한국과 다른 점은 “정당한 이유 없이 출석하지 않으면 1년 이하 징역 또는 10만 엔 이하의 벌금에 처한다”라고 형사처벌 규정을 명시하고 있기 때문에 출석 대상자들이 이유 없이 불출석하기가 상당히 어렵다.

이라 쓰고 훌리건들이라 읽는 이들이 감독에게 팀 상황 등에 대한 해명을 요구하는 행위이다.
- 명절증후군의 일종으로 자식 세대들이 부모 세대들에게 "결혼은 언제 하냐, 취직은 언제 하냐?" 등과 같은 것들을 묻는 스트레스를 주는 행동을 잔소리처럼 짜증이 날 법한 표현으로 "청문회 당했다!" 라고 비꼬기도 한다. 그리고, 일부에서는 그런 질문을 던지는 의도가 그 동안의 실적이나 성과를 발표 또는 브리핑할 것을 요구하는 점에서 주주총회로 비유하기도 한다. 학부모들이 자신의 자녀에게 공부를 강요하는 것을 주식 시장으로 비유한다면 자녀들을 주식 시장에 상장시키기 위한 목적이라고 보면 된다.
