1. 개요
대인지뢰 금지 협약(Convention on the Prohibition of Anti-Personnel Mines. 일명 오타와 협약)이 1997년에 출범했다. 대인지뢰에 의해 많은 민간인이 피해를 입자 이것을 막자는 의도로 만들어진 국제협약이다. UNTC에 따르면 2025년 기준 총 165개국이 이 조약을 비준 또는 서명하였다. #2. 한계
그러나 미국, 러시아, 인도, 중국과 같은 주요 강대국은 물론이고 파키스탄, 이스라엘, 소말리아 등 분쟁국가들, 사우디아라비아와 모로코 같은 아랍 세계의 친미 국가들, 그리고 휴전상태인 대한민국과 북한 모두 이 협약에 가입하지 않았다. 거기에 이 나라 중 몇몇은 무기수출 세계 상위권을 차지하기에, 있으나 마나한 조약인 셈이다. 하지만 지뢰를 한쪽에서는 사용하는데 다른 쪽에서 금지한다면 지뢰를 사용하는 쪽이 엄청나게 유리해지므로 어쩔 수 없는 측면이 있다. 미국에서는 2014년 지뢰금지 의사를 밝혔지만, 한반도에서는 예외로 하겠다고 선언했다. 이유는 당연히 북한군의 남하 저지.남북한은 휴전선 근방에 엄청난 수의 지뢰를 깔아 놨다. 이를 불발탄까지 포함해서 모두 제거하려면 수백년 걸린다는 이야기가 있을 정도로 이 지역은 지뢰 밀집 지역이다. 워게임 등의 시뮬레이션을 해 보면 휴전선 지대에 지뢰가 깔려있고 안 깔려있고의 차이가 전황에 상당한 영향을 미친다. 게다가 장기적으로 보병 병력이 크게 부족해질 것인데, 지뢰지대를 깔아 놓아 적의 공세를 중간에 정지시키지 않으면 방어선이 그대로 뚫리게 된다. 따라서 지뢰를 없앨 가능성은 한반도 통일이 되지 않는한 사실상 없다고 봐도 된다.
북한 특유의 제파 전술은 (경제난이 없다면 이론상으로는) 1차공세에만 교도대 포함 100만 대군이 동원되고 최대 300만까지 투입 가능한데[1] 저출산에 따라 감축 추세에 있는 부족한 병력으로 이를 전장에 묶고 반격을 준비할 시간을 벌기에 지뢰는 효과적이다. 북한이 휴전선을 정면으로 돌파하는게 불가능한 것이 이 지뢰 때문이라고 봐도 무방하다. 특히 북한은 지뢰제거차량도 없고, 방호구도 없는데, 지뢰밭을 돌파하겠다니 그게 가능할 리 없다. 게다가 맨몸으로 내려오다 지뢰를 밟으면 주변의 몇 명까지 피폭당하는데 열약한 사정상 치료는 아예 포기할 수밖에 없다. 그나마 수색대로 휴전선 이남에 지뢰가 없는 곳들을 미리 파악해 놨겠지만 그런 곳들은 오솔길 수준인데다 그런 곳으로 일렬로 오면 방어 측에선 십자포화를 집중해 막기가 쉽다.
하지만 예외도 있다. 클레이모어같은 사람이 직접 눌러 터뜨리는 지향성 지뢰는 금지협약에 포함되지 않아 협약 가맹국이라도 얼마든지 만들어 쓸 수 있다. 애초에 심고 나서 관리가 안 된다는 문제 때문에 조약이 나온거라 심고 직접 터트리는건 별 문제는 없으니. 그래서 현재 개발되는 신형 지뢰무기의 경우에도 죄다 무선지령식으로 개발되는 경향이 있다. 예를 들면 대한민국 국군의 K421 원격운용통제탄[2] 등.
대한민국은 오타와 협약에 가입하지 않았지만, 특정재래식무기금지협약에 가입하면서 2001년에 지뢰 등 특정 재래식 무기의 사용 및 이전의 규제에 관한 법률을 통과시켰다. 이에 따라 대한민국 국군은 탐지되지 않는 지뢰[3]는 새로 매설할 수 없다.[4] 2025년 2월부터는 "지뢰의 제거 등 지뢰대응활동에 관한 법률"이 추가로 시행됐다.
3. 협약의 유명무실화 움직임
2020년대 우러전쟁이 일어나고 전 세계에 전운이 감돌자 이 조약 역시 휴짓조각이 될 상황에 처했다. 이미 집속탄 금지 협약을 탈퇴한 리투아니아를 비롯하여 폴란드와 핀란드 역시 오타와 협약 역시 탈퇴를 검토하고 있다. 막상 당사자들이 이웃의 깡패 국가에 의해 심각한 안보 위협을 받게 되면 인도적 조약같은 것은 빛 좋은 개살구에 불과한 것이다. # 이후, 이것에 대한 것이 더욱 구체화되었는데, 2025년 3월 19일 폴란드와 함께 리투아니아, 에스토니아, 라트비아 4국이 공동으로 지뢰 금지 협약 탈퇴를 결의했다. # 이에 대하여 국제 지뢰 금지 캠페인(ICBL) 측은 라트비아의 이러한 움직임을 규탄했는데, 다른 3 국가에 대한 의견은 없는 상태다. #이미 협약 당사국인 우크라이나는 침략국인 러시아가 지뢰를 마구 사용하므로 이에 맞서 이 조약을 무시하고 소련 시절 쟁여둔 지뢰를 마구 매설하고 있으며 미국이 지원한 군수물자에도 지뢰가 포함되고 있다.
